Site Management and Condominium Law
Understanding the Turkish laws about site management is not always easy. Here's some important information you should know about site management:
1. If a site has more than 8 separate living units, having a site manager is legally required. The site manager must be elected at the AGM (Annual General Meeting). The AGM is only valid if the majority of the house-owners join it. For example: if there are 30 house owners, 16 house owners must join the AGM for the election to be legitimate.
2. If a majority can`t come together to elect a manager, one can apply to the court for a manager to be appointed by a judge. The manager does not need to be a house owner, unless the management plan states otherwise.
3. It is also legally required to have an inspection of the Business Records of the Site. Due to the Condominium Law the inspection has to be executed by the Board of Owners every three months unless the Management Plan regulates the intervals of inspection specifically otherwise. In any case, the inspector must be a house owner.
4. The Site Management must consist of at least three institutions: 1. AGM; 2. Manager; 3. Inspector
5. A Management Plan must be registered at the Land Registry Office. In addition to the requirements of the Condominium Law a lot of issues are regulated in the Management Plan. Those regulations are for example the aspect of terraces, windows, gardens etc.
Land Registry
You must be registered to the Land Registry (Tapu) to become legally and officially the property owner. The most common form of land ownership in Türkiye, especially in the touristic regions, is the shared ownership. Most of the people who buy houses, don't know that they are sharing the land on which their houses are build. On the excerpt from the Land Register you will see it as a fraction. For example: there are 13 houses in a Site,
on the excerpt you will see that you share 1/13 of the total parcel. This kind of property is just as valuable as a sole property but it is important to know this before buying as there are some restrictions on the use.
All the restrictions and peculiarities are regulated in the Condominium Law and Management Plan.
Power Of Attorney
In order to be able to represent you and be able to take action in your name, a Power of Attorney (Vekalet) will have to be issued.
This is a document that needs to be certified by a Turkish Notary (Noter).
The content can vary depending on your needs and will in any case be translated to you by a certified translator before it needs to be signed.
